Terms and Conditions - Version 1.4 23.10.2023

The terms and conditions outlined here are generic to our company and events as a whole. There are standalone rules for each event also. However the terms and conditions contained herein supersede/and or run in conjunction with the particular event rules.

Refunds/Transfers for events.

When entering a race, you will have the chance to purchase optional cancellation cover(Food and accommodation bookings are not covered by the cover.). The cancellation cover is offered by a third party. Further information is available here.www.refundable.me

If you can not make the event then any merchandise you have ordered will be posted out to you and so it not covered by cancellation cover or transfers.

If you can not make the event for any reason, you can always complete the event as a virtual option. All you need to do is email proof of running the required distance to admin@trailoutaws.com . Your medal and race goodies will then be posted out to you.

Transfers to other runners are allowed upto 3 weeks before the event. All transfers must be made emailing admin@trailoutlaws.com

If you volunteer at the event you can't make or volunteer at another event. Then you can also claim a free place for an event. You can sign up to volunteer at trailoutlaws.com/volunteer

Discounts

A 10% discount is available on race entries for the Marathon distance and Ultra distance events for current or ex- Military personnel.

A 10% discount is available on race entries for the Marathon distance and Ultra distance events for NHS, Emergency service staff (including Mountain Rescue, Police, Fire and Rescue, Ambulance Service and Coast Guard), HMP prison service staff. To be considered for these discounts you must contact Trail Outlaws Ltd via email prior to processing your entry payment for the discount to be applied. A discount cannot be reimbursed or cost recalculated after payment for an entry has taken place. This is solely the responsibility of the event entrant to do so prior to the event payment being processed.

Trail Outlaws Ltd reserve the right to change and or refuse any discount.

Nature of Event & Safety

Trail Outlaws Ltd have an obligation to ensure that the event is as safe as possible without diminishing the nature of the challenge. Participant safety is ultimately each participant’s personal responsibility.

By participating, you accept that is it your responsibility to keep yourself and/or your team safe. You understand that the event organisers will not always know your location during an event, and you accept that it is your responsibility for ensuring the event organisers know your location in the event of an incident. You accept that a rescue may be inherently dangerous, and by seeking/accepting assistance you accept the risks involved.

Any exchange of entry will require the new runner to accept fully the Terms and Conditions enclosed within this document.

By participating in the event you fully realize the dangers of the event and fully assume the risks associated with such participation, including but not limited to the following dangers; exhaustion, collision with pedestrians, vehicles, other participants and fixed or moving objects, weather conditions, animals, the possibility of physical and or mental trauma and injury including death.

At any point during the event, you may be required as part of the event route to cross over and or move along side roads and other byways. You may be required to cross rail crossings. At any such time you choose to do this, you do so knowing the risk involved in such an endeavour. Any liability for crossing and or using the aforementioned is solely the responsibility of you the participant, and you are aware of the risk of doing so. The organiser Trail Outlaws Ltd hold no responsibility for your safety at any such crossings.

If at any time you have to retire from an event, you accept that it is your sole responsibility to inform the event organiser/ Race director. Both asap (by phone - NB you must receive a reply acknowledging that your sms has been received) and asap in person / via an event official. You must confirm in person at the event HQ or go to the nearest marshalled checkpoint ahead of you on the current route of the event, as any previous checkpoint may have closed down and moved on.

Payments

We accept most major credit and debit cards, however these payments are taken through our sub contracted ticketing system in place on or embedded within our website, or if you are redirected to our ticketing systems website for payment. We also accept BACS transfers (please contact via email for BACS payment details) and cheques made payable to Trail Outlaws Ltd (please contact via email for address details to send cheque payments, once payment has cleared you will be entered live into the event).

We reserve the right to refuse any payment for any event should we believe or suspect that the payment method being used is not genuine for any reason.

“Early Bird” entries are only available if payment has been received and cleared prior to the date advertised as the “Early Bird” discount.

We reserve the right to change the cost of event entry prior to any payments being cleared, at any time.

Indemnity Waiver

You the participant in the event hereby waive any and all rights and/or claims you may have against the Organisers Trail Outlaws Ltd, its employees, directors, consultants, and event sponsors for any damages and/or claims that may arise directly or indirectly from participation in the Event. Including but not limited to, the following dangers; exhaustion, collision with pedestrians, vehicles, other participants and fixed or moving objects, weather conditions, animals, the possibility of physical and or mental trauma and injury including death.

You the participant fully realize the dangers of the event and fully assume the risks associated with such participation, including but not limited to the following dangers; exhaustion, collision with pedestrians, vehicles, other participants and fixed or moving objects, weather conditions, animals, the possibility of physical and or mental trauma and injury including death.

You the participant acknowledge that the organiser holds not responsibility for your medical well being and any and all personal medical conditions and medications or your sole responsibility, whether you have declared them to event organiser or not.

You the participant are recommended to have a full medical check from a GP prior to engagement in the event to confirm your ability to take part.

You declare yourself physically fit and able to take part in the event.

You agree to abide by the rules and conditions laid down for the event and to follow instructions issued by the organiser of the event. You understand that circumstances beyond the control of the organisers may cause the event to be modified, postponed or relocated.

Insurance

The Participant acknowledges that it is their responsibility to obtain insurance cover for their participation in the event and they also acknowledge that the organiser does not provide insurance cover for the participants in the event.

Participants are strongly recommended to take out appropriate insurance that covers their participation in the event and repayment of their entry fee should they be unable to participate.

Format Changes

The organisers reserve the right to change the date, timings, location and format of any event if necessary, without prior consultation with the participant/s.

The organisers reserve the right to cancel any event without prior notice.

If the organisers are forced to cancel an event for any reason, a new date will be established and all entries carried forward.

If no alternative date is available, all entries will be carried forward to the follow year.

If the event has to be cancelled in its totality there will be an option to do the event virtually or to switch to another event in the same calendar year.

Photography

Photos of you may be published online. Photos published online may be viewable publicly.

By taking part in the event you are agreeing to all image rights belonging to the organisers of the event.

Personal Belongings

Any personal belongings brought to an event are left entirely at the participant's own risk - this includes designated bag drop areas.

Participants are advised to bring only limited valuables to events and, if necessary.

Due to the nature of the events, not all baggage or equipment can be kept secure at all times.

It is the responsibility of the entrant to check the Term and Conditions upon entry and 1 week prior to the event.

The organiser does not have to inform the participant of indention to change and make additions to this document.
